Terms of Service
In plain words
- StoreClock records when your workers clock in and out, and adds up hours and pay from the rates you type in.
- It does not pay anyone, file taxes, or give legal advice. Paying your workers correctly is your responsibility.
- Your data is yours. We do not sell it. We do not look at your hours or pay.
- Each store is its own plan. No refunds for time already paid. Cancel anytime.
- Tell your workers the app checks their phone's location when they clock in or out.
- Settings like overtime and unpaid breaks are your choice. Turning overtime off does not change what the law requires. We record who changed it and when.
- You and your managers can send messages to your team. You are responsible for what is sent. Messages are not for emergencies.
This box is a short summary. The full Terms below govern.
These Terms of Service ("Terms") govern your access to and use of the StoreClock™ application, website, and related services (together, the "Service"), provided by Coam Tracker, LLC, a Georgia limited liability company ("StoreClock," "we," "us," or "our"). By creating an account, paying for a plan, or otherwise using the Service, you ("you," "your," or "Customer") agree to these Terms. If you do not agree, do not use the Service.
1. The Service
StoreClock is a subscription software tool that lets the people who work for your business record the times they start and stop work ("punches") — usually by scanning a printed store barcode with their own phone and entering a PIN, or by entering a PIN on a shared tablet ("kiosk") — and that adds up hours, overtime, and pay amounts from the pay rates and settings you enter. The Service may also include optional schedules, open shifts, alerts (for example late, no-show, clock-in, clock-out, and forgot-to-clock-out alerts), daily and weekly report emails, tips, commission, and bonus lines, payroll export files, manager access, team messages from you and your managers to your workers, and an optional photo at each kiosk punch. The Service is provided on a software-as-a-service basis through a web browser or an installed web application.
The Service is a record-keeping and calculation tool. It does not pay wages, withhold or file taxes, act as a payroll provider or employer of record, or give legal, tax, accounting, or human-resources advice. You remain solely responsible for: paying your workers correctly and on time; deciding how work time, breaks, overtime, rounding, tips, and commission are treated; checking every total before you rely on it; and following every law that applies to your business, including federal, state, and local wage-and-hour, overtime, meal-and-rest-break, child-labor, recordkeeping, scheduling, and privacy laws. Settings in the Service (for example an automatic unpaid break, overtime after 40 hours in a pay week, or a pay week start day) are tools you choose; they are not a statement of what any law requires for your business.
Pay settings you choose. Some settings change how totals are figured — for example, turning overtime off, or taking an automatic unpaid break after a number of hours. Overtime is on when a store is created. Turning a setting on or off is your decision and does not change what any law requires of you. Before overtime can be turned off, the Service asks you to confirm, and it keeps a record of who changed overtime or the automatic break setting, and when. That record is part of your store's data.
Schedules, alerts, and reminders are a convenience. The punches are the record. An alert or email that is late, missing, or wrong does not change what was recorded, and you should not rely on an alert as your only way of knowing who is working.
2. Accounts, Managers, and Workers
You must give accurate information when you create an account and keep it up to date. Your email address is your login. You are responsible for keeping your password private and for all activity under your account, whether by you, a manager, a worker, or anyone else you let use the Service.
You add your own workers and managers, set their PINs, and choose what each manager may see or change. You are responsible for the people you add, the permissions you give them, and for removing a person's access promptly when they leave your business. Anything done with a manager username, password, or PIN, or a worker PIN, for your store is treated as done under your account.
You must be at least 18 years old and have authority to bind the business you represent. Workers do not open accounts with us; they use the Service only through your store.
3. Plans, Billing, and Cancellation
The Service is offered by subscription. Your first store is your main plan, billed monthly or yearly as you choose. Each store you add after that is its own separate plan, billed monthly or yearly, charged in full on the day you add it, and renewing on its own date. Prices are shown before you pay and at storeclock.com/pricing. We do not prorate or split billing periods.
A new account may start with a free trial period (currently 14 days, no card needed). When the trial ends, owner features for that store are locked until a plan is paid; workers can still clock in and out so no time is lost. We may change or end free trials for new accounts at any time.
We may offer a limited-time price (for example, a founding price for yearly plans started before a stated date). A limited-time price applies for as long as that plan stays active and uncancelled; if the plan ends and is started again later, the then-current price applies.
Payments are processed by our payment processor, Stripe. We do not receive or store your full card number. Charges appear on your statement as COAM TRACKER LLC.
Plans renew automatically until cancelled. You may cancel any store's plan, or all of them, at any time in the app (Menu → Account → Billing → Manage billing). Cancelling stops future charges only; you keep access to that store for the full period you already paid for. All payments are final and non-refundable, in whole and in part, for monthly and yearly plans, except where a refund is required by law. This no-refund policy is shown to you before you pay. We may change prices for future billing periods with reasonable advance notice. We may also offer free time on an account at our discretion; free time can be changed or ended at any time.
If a store's plan ends or a payment fails, that store's workers can still clock in and out so no time is lost, but reports, exports, and most owner features for that store are locked until the plan is paid again. We may suspend an account whose payment is disputed or charged back.
4. Location, Phones, and Photos
When a worker clocks in or out on a phone, the Service checks the phone's location at that moment to confirm the worker is at or near the store, and saves that location with the punch. If you turn them on, the Service also checks whether the phone is on the store's internet and whether it scanned the store's live barcode, for the same purpose. A punch the Service cannot confirm is saved and waits for your approval; a punch clearly far from the store is refused. The Service does not follow a worker's location at any other time. Each worker's PIN is locked to the first phone that uses it, to stop one person from punching in for another; you can reset it.
If you turn on photos for a kiosk tablet, the tablet takes a picture each time a worker clocks in or out. Photos are kept for the number of days you choose and then deleted automatically. The Service does not use facial recognition, face geometry, fingerprints, or any other biometric identifier.
You are responsible for telling your workers, before they use the Service, that their phone's location is checked at each punch and, if you turn it on, that a photo is taken at the kiosk, and for getting any notice, consent, or posting that the laws where you operate require.
5. Team Messages and Alerts
The Service lets you, and managers you allow, send messages and alerts to your workers' phones (for example, ready-made messages about schedules, deliveries, or safety). You are responsible for every message sent from your store, including by your managers, and for making sure messages follow the law and your own workplace rules. Do not use messages to harass, threaten, or discriminate against anyone, and do not send Social Security numbers, bank details, medical information, or other sensitive personal information.
The Service blocks a list of offensive words and limits what managers can send, but no filter is perfect, and we do not review messages before they are sent. Messages are kept in your store's records with the sender's name, the time, and who received them, until you delete them or delete your account.
To use the Service on their own phone, workers are asked to turn on alerts and to add StoreClock to their phone's home screen. You are responsible for telling your workers about this, for any notice or consent the laws where you operate require for sending work messages to workers' personal phones, and for any rules about contacting workers outside their working hours.
Messages and alerts depend on phones, internet connections, and the push services run by Apple, Google, and others, and can be late or not arrive at all. Messages are not an emergency system. In an emergency, call 911. Do not rely on a message as the only way to tell a worker something important.
6. Acceptable Use
You agree not to: (a) use the Service for anything unlawful, including to under-record, round away, or alter hours in a way the law does not allow; (b) try to get into another account, store, or our systems, or get around the location check, phone lock, or PIN limits; (c) reverse engineer, decompile, or try to extract the source code of the Service, except where the law allows; (d) resell or provide the Service to anyone outside your own business without our written consent; (e) use the Service in a way that could disable, overload, or harm it; (f) use messages or alerts to harass, threaten, or discriminate against anyone, or to send unlawful content; or (g) copy or imitate the Service's screens, designs, or other non-public parts to build a competing product.
7. Your Data
You keep ownership of the data you and your workers put into the Service, including worker names, PINs, pay rates, punches, schedules, and reports ("Customer Data"). You give us a limited permission to host, process, and display Customer Data only as needed to provide the Service to you.
To run, secure, bill, and support the Service, our administrative tools show us account-level information only: the owner's name, email, and phone, store names, plan and renewal status, how many workers a store has, whether set-up steps are done (location set, barcode printed, first punch made), and the date a store was last used. Those tools do not show punches, hours, pay rates, or pay. We look at the underlying records only when you ask us for help, to investigate misuse or a security problem, or when the law requires it.
Owners can change punches. Every punch an owner or manager adds, changes, or deletes is marked "edited" and kept in a change log. You are responsible for any change you or your managers make.
Pay and time records may need to be kept for years under the laws that apply to you (for example, federal law generally requires payroll records to be kept for at least three years). The Service lets you download your reports and payroll files at any time. You are responsible for keeping your own copies; do not rely on the Service as your only record.
8. Security Incidents
If we learn of a security incident that affects Customer Data, we will look into it promptly, take reasonable steps to contain it, and notify affected customers without undue delay and as the law requires, including what happened and what we are doing about it. The Service keeps each store's data separate at the database level and limits each worker to their own records.
9. Intellectual Property
The Service — including its software, screens, designs, logos, reports, and documentation — is owned by Coam Tracker, LLC and protected by United States copyright, trademark, and trade-secret laws. Subject to these Terms and payment, we give you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own business during your subscription. You may not copy, modify, distribute, or make derivative works of the Service, or remove any copyright or trademark notice.
"StoreClock" and the StoreClock logo are trademarks of Coam Tracker, LLC. You may not use them, or anything confusingly similar, without our written permission, except to truthfully name the Service. If you send us ideas or feedback, we may use them freely with no obligation to you.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PHONES, INTERNET CONNECTIONS, GPS, CAMERAS, PUSH NOTIFICATIONS, AND EMAIL CAN FAIL. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT EVERY PUNCH OR ALERT WILL BE RECORDED OR DELIVERED, OR THAT ANY HOURS, OVERTIME, PAY, OR OTHER TOTAL IS ACCURATE OR MEETS THE LAW THAT APPLIES TO YOU. YOU ARE SOLELY RESPONSIBLE FOR CHECKING ALL HOURS AND PAY BEFORE YOU RELY ON THEM.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COAM TRACKER, LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST BUSINESS, UNPAID OR OVERPAID WAGES, WAGE CLAIMS, PENALTIES, OR FINES, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
Some places do not allow some of these limits, so some of them may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless Coam Tracker, LLC and its members, officers, and agents from any claims, damages, losses, fines, penalties, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your breach of these Terms, or your breach of any law or anyone's rights — including any claim by a current or former worker about wages, hours, breaks, overtime, scheduling, location checks, photos, messages, or privacy; any setting you or your managers choose (including turning overtime off or using an automatic unpaid break); any message sent from your store; and any reliance on a total produced by the Service.
13. Ending Your Account; Selling or Closing Your Business
You may stop using the Service and cancel at any time. We may suspend or end your access if you break these Terms, do not pay, or for any other reason with reasonable notice; we may suspend access right away when needed to protect the Service, other customers, or to follow the law.
You can permanently delete your account yourself in the app (Menu → Account → Billing → Delete my account). Before you do, download any reports and payroll files you need to keep. Deletion requires your password and a typed confirmation, and cannot be undone by you or by us. Deleting your account does not refund any amount already paid; if you only want to stop future charges, cancel instead.
Accounts are not transferable. If you sell your business, do not give your login to the buyer — it would show them your workers' names, PINs, pay rates, and hours. The buyer opens their own account. What records the buyer receives is a matter between you and the buyer.
14. Changes to the Service and These Terms
We may add, change, or remove features of the Service. We may update these Terms; the version number at the top will change and material changes will be communicated by email or in the app. Using the Service after a change takes effect means you accept the updated Terms. You may be asked to agree again the next time you pay.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved only in the state or federal courts located in Georgia, and you agree to the personal jurisdiction of those courts.
16. Other Terms
If any part of these Terms cannot be enforced, the rest stays in effect. These Terms, together with our Privacy Policy, are the whole agreement between you and us about the Service. Not enforcing a right is not a waiver of it.
